GENERAL
No agency, partnership, joint venture, employee-employer, franchiser-franchisee relationship, etc. is intended or created by this Agreement. You acknowledge that you have all necessary permits to grant us with Customer's personal data to fulfill this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In Cascadian Goat sole discretion, Cascadian Goat may assign this Agreement upon notice to you. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. Cascadian Goat does not guarantee it will take action against all breaches of this Agreement. Cascadian Goat reserves the right to transfer or assign this Agreement or any right or obligation under this Agreement at any time.
LIMITATION OF SERVICE
Cascadian Goat services are provided on an AS IS - WITH ALL FAULTS basis
Your use of any Cascadian Goat or Stevens Passion services is entirely at your own risk
Cascadian Goat does not guarantee the availability of our service at any given time, or the reliability of our service when it is available. Cascadian Goat does not guarantee the integrity of, or the continued availability of, files on our servers. Cascadian Goat does not guarantee the restoration or availability of files which may be backed up.
Cascadian Goat disclaims all warranties, express and implied, including without limitation implied warranties of service and merchant-ability. Notwithstanding anything else stated in these terms, and irrespective of whether Cascadian Goat does or does not take measures to change content.
Your sole remedy for any loss of any services and/or information by using Cascadian Goat service is to discontinue your use of the service. Cascadian Goat will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use Cascadian Goat's services.
LIMITATION OF LIABILITY
YOU ACKNOWLEDGE AND AGREE THAT, TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, Cascadian Goat AND ITS ENTITIES INCLUDING BUT NOT LIMITED TO ITS AUTHOR AND HOST WILL NOT BE LIABLE TO YOU OR TO ANY OTHER PERSON UNDER ANY CIRCUMSTANCES OR UNDER ANY LEGAL OR EQUITABLE THEORY, WHETHER IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL LOSSES OR DAMAGES OF ANY NATURE EVEN IF AN AUTHORIZED REPRESENTATIVE OF A Cascadian Goat ENTITY HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, THIS DISCLAIMER APPLIES TO, BUT IS NOT LIMITED TO, ANY DAMAGES OR INJURY ARISING FROM ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECTS, DELAY IN OPERATION OR TRANSMISSION, LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA, WORK STOPPAGE, ACCURACY OF RESULTS, COMPUTER FAILURE OR MALFUNCTION, COMPUTER VIRUSES, FILE CORRUPTION, COMMUNICATION FAILURE, NETWORK OR SYSTEM OUTAGE, THEFT, DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, LOSS OF USE OF ANY RECORD OR DATA, AND ANY OTHER TANGIBLE OR INTANGIBLE LOSS. SUBJECT TO THE FOREGOING, TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, NO Cascadian Goat ENTITY WILL BE LIABLE FOR ANY DAMAGES OF THE FEES PAID BY YOU IN CONNECTION WITH YOUR USE OF THE Cascadian Goat SITES PRECEDING THE DATE ON WHICH THE CLAIM AROSE.
PROHIBITED USE
All visitors and users are prohibited from; leasing, selling, copying, sublicensing, transferring, or assigning any information, intellectual property, goods, or services provided on this site. You are prohibited from using Cascadian Goat for any illegal purpose, gaining unauthorized access to data, altering, modifying, adapting, reverse engineering, decompiling, disassembling, or hacking intellectual property, altering or modifying another website to falsely imply that it is associated with Cascadian Goat, using or exporting the Cascadian Goat information, products, or services in violation of U.S. export laws and regulations, violating anyone else's legal rights (for example, privacy rights) or any laws (for example, copyright laws) in any governing jurisdiction, using Cascadian Goat or its services to transmit content that could be deemed unlawful, threatening, harassing, racist, abusive, libelous, pornographic, vulgar, defamatory, obscene, indecent, or otherwise inappropriate, including any messages constituting or encouraging criminal conduct. You are prohibited from; breaching, or attempting to breach, Cascadian Goat security measures and systems, or enabling third parties to violate the Terms of Use.
RESERVATION OF RIGHTS
Cascadian Goat reserve the right at any time and in its sole discretion to order removal of all links or any particular link to Cascadian Goat. You agree to immediately remove all requested links to Cascadian Goat upon receipt of such request.
RELEASE
You release us (and our officers, directors, agents, subsidiaries, joint ventures and employees, author, host, creator) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. You agree that Cascadian Goat has no control over and does not guarantee the delivery of the advertised collaborations and that Cascadian Goat shall be released from any and all damages resulting from the failure to receive any benefits of an anticipated collaboration.
IMDEMNITY
You will indemnify and hold Cascadian Goat (and its officers, directors, agents, subsidiaries, joint ventures and employees, author, host, creator) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
LAW AND JURISDICTION
If a dispute arises between you and Cascadian Goat, we strongly encourage you to first contact Cascadian Goat directly to seek a resolution. Cascadian Goat will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation. Contracts for the purchase of Products through our Site and any dispute or claim arising out of or in connection with them or their subject matter or formation ( including non-contractual disputes or claims) must be resolved by a court located in the State of Washington. Any dispute or claim arising out of or in connection with Agreement or its formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of the State of Washington.
MODIFICATIONS
Cascadian Goat reserves the right, at its discretion, to modify this Agreement, fees, charges, terms at any time. The User shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Service by the User following such notification constitutes the User's acceptance of the terms and conditions of changes as modified.
